    do i need to give the $$ back?

    ok...so legally speaking...im not looking for ppls opinons, i want the law...

    heres the story...i recently "sold" my cb7. some guy came and gave me a $300 deposit and came a few days later again. this time, he wanted me to follow him an hour away to see his exwife, and exchange hands. i did so. he ended up not wanting the car and wants his deposit back. legally, do i owe it to the bastard? or can i claim somehting b/c i had to drive an hour and an hour back. thanks guys

    and also, i would give it back, as much of a headache as it is to you, because karma is a bitch.

        talk about headaches...first buyer tried to scam me (read certified check fraud thread in OT), and now this jerkoff who makes me drive hour each way, waste half a day, and now he wants his $ back...sheeesh

        its not fuckin fair all i want is a manual cb7 coupe...is that too much to ask for...damn

          well technically according to my law class, you dont have to give the money back unless he specified that if he doesnt want he can get his money back i think so

            remember when recieving "earnest money", always write a receipt stating how much, for what it is for, and for how long the money is good for.. in that way if your buyer doesn't come back on the date stated, the money would therefore be forfieted(sp?) and you have all the right to keep the money..

                  the whole point of a deposit is the person giving his word that he will be paying the rest when the deal goes thru.. but idk... give most of it back, im sure they would be able to understand if u kept like 25 for the effort and gas.

                        Gas money, and any expenses incurred while driving to his house should be yours. After that, just give the money back.

                        Legally, you could be in the right. However, the only to ensure that would be to do what CasterX said. Even then, the guy could take it to court. You could legally be in the right, but it would cost more in the end to prove it!
