Tdot Claim For Damages

I found this on www.Tennesseeminis.com a site that i used to be active in when i had a minitruck. If you ever get a wheel, Tire, or anyother damage to your car due to roads being bad or whatever. I take no credit for any other part of this post below. The reason i am doing this is because i had one of my rims crack in half due to a pot hole in the road. PEACE

if you damage a wheel you are allowed to file a claim against TDOT. It must have taken place on a publicly maintained road and had to be an obstruction in the road not a temporary obstruction ON the road. IE a pot hole would be an obstruction on the road. A temp obstruction would be a bottle or glass. TDOT will have 90 days to be found negligent in the case (meaning if someone had called and reported the hole prior and TDOT did not fix it) After the 90 days if TDOT was not found negligent then you will have to do an appeal. This an take an additional 60 days but if you want any compensation this must be done. Here are a few things you will need to file your claim
1. This form http://www.tdot.state.tn.us/legal/claimform.pdf
2. a discription of what happened and what damage was caused. Pics and a police report are VERY helpful in this situation. Street names location and time of day along with road and weather conditions as well
3. List of any and all witnesses to your claim
4. 2 estimates on the cost to cure any damages.
5. Contact this number and ask for the claims department. 615.741.2734 they will tell you where to fax your form and who your point of contact will be. Make sure to document all contact and discussions. This will help you in the long run.
