04-07 > 08. The 08 may be slightly faster on a track (and I've seen a video to confirm it) but the 04-07 is faster in a straight line, and is still a much more aggressive car overall.
Right under $40k? Man, that's a lot of money for a Subaru...Seriously, that's getting into BMW territory. Granted, that'd be a pretty stripped down 3 series, and it couldn't keep up with the Subie, but still, I'm unsure about that pricing. I just don't understand who it's being marketed towards; I think they have too wide of a target audience. Track junkies couldn't care less about the car's added refinement (I imagine it's a turn-off even), and someone looking for a truly refined, yet sporty car will look elsewhere (Acura, BMW, Infiniti, etc.). Performance-wise, it's still a good deal though, and I guess that's what matters.
Also, the reviews I've read gave the impression that the car was largely the same as the outgoing model technically (aside from the slightly softer suspension), but this review points out a number of revisions.

There was a modded black one for sale a while back. I think it was used for R/D on parts it looked pretty nice. IMO stock they look like poo but when you mod anything its a different story. But it depends some cars you can mod and it stilll looks like shit. Example = Pontiac Aztek.
