I got rear ended today

    Quick question regarding the accident. I think the police officer either made a clerical error on the report or is trying to make a problem for me.

    Most police reports have a "Contributing Circmustances" box. He put me as "driver inattention" and the other driver as "none". The report states that I was hit from the rear while stopped at light by the other driver. According to the driver manual, I did everything right by keeping my foot on the brake to avoid hitting other cars (since I was the first car at the light, I avoided plowing into oncoming traffic). Even if I noticed the other driver was going to hit me, I still did what the driver manual indicates.

    Damage question: The metal behind the rear bumper is bent, the ground can be seen when looking into the trunk which does not close. Is this part of the frame or the bumper support?

      Total loss. Their insurance is only paying me $300. Do you believe that? They should pay at least $600.





      They said the car has rust and other prior damage bringing the book value down.

        wow, ur insurance must suck? no offense...but that should be at least 1000 depending on the mileage and stuff

          The damage is $2200, the other driver's insurance is declaring a total loss and deducting existing damage from the book value. It turns out that the existing body repair is costing more than the book value. So, the adjuster said the car is considered "basic transportation" and $300 will be paid. I will contact them.

                  I am still asking for more money. What about the car? Despite the damage, everything works. I hate to see it getting crushed at the boneyard.

                    forget about how much $ you got for the car (15+ yr old car anyways....get off the blue book shit guys, actual cash value of the vehicle is the game insurance companies play)....

                    what tort option do you carry on your policy? if you carry full tort you should make a bodily injury claim for your neck....easy 10K....35K if you want to drag out the claim...if you carry limited tort you're basically fucked (you can only make an injury claim for "catostrophic injuries")....

                      I got hit like that but much worse and from the brief pics you supplied you might need part #17 which is atleast $300 prior to labor.

                        Hypothetical question

                        Lets say the car was in a parking lot and got flatted by a huge dump truck used in mining operations. Is the adjuster going to inspect any prior damage to the car. This really sucks.
