some good arguments:

yes it is her parents who can decide to press the charges, but what she has to say is still relevant to the case. she is of the age to make concious decisions and is aware of her actions, it's not like she was literally a child and you had sexual relations with her. she is aware or what happened and that will be aknowledged along with what the parents are trying to charge you with. she can speak for herself. and if her defense says that she was in even less of a position to make a responsible choise because she was intoxicated, then you can argue the same because alcohol will impair judement whether you're 15 or 20. so in case they use that, then it gives you the equal ability which you can say that if they're using her intoxication to make you guilty, than you can use YOUR intoxication to exempt you in the same she was would be exempted from making a better choise.

like someone said it could easily be bargained down to the deliquancy of a minor versus the rape or sex offender. that is extreme. also if i understood correctly, you have no prior history of this or any other form of law breaking. you are clearly not a predator or a danger to society, just a young adult who got intoxicated and made an irresponsible mistake. if you had prior offences, i'd be more worried, but i'd be surprised if this even made it anywhere. you can probably settle. also i don't think you answered how this whole situation became known to the parents, did she turn on you, or did they find out? is she against you or at least admit to it being a mutual choice you both made.

the judicial system isn't out to ruin people's lives. i highly doubt they would go so far as to ruin your life for something so minor. (no pun!) you didn't have sex. and if she testifys that you didn't have sex, but she happens to also not be a virgin, which is something that should be determined, then it makes you look even less guilty, in the fact that you didn't really even make her a delinquant, as what you engaged her in didn't surpass what she had already done before with someone else. so if she's not a virgin, you didn't do anything with her that she hadn't already done. state your case, if it makes her look like a slut, or reveals it rather, then oh well. nothing will happen to her, it's your wellbeing on the line.

Second, if she didn't report it till DAYS later it will get thrown out by a judge. Even if the parents report it they will do the same.

Also was SHE drinking? Cause there is a loophole out. They would argue that she had no recollection of what happened and that she has a crush on you and you didn't have the same feelings back so she made this up ( which happens ALOT) and is the reason like ricky said that rape cases get overturned and thrown out..

I've been following this thread, and I gotta agree to some extent to what jdmcord has to say ..

Once you hire your lawyer .. and you shoud've done that by now, you don't have to say anything,
to anyone .. the lawyer will do/say everything ..for you .. I would however, be upfront with said lawyer.
I would'nt *lie* to him/her .. and I would'nt hesitate to hire a female lawyer in this case ..
You didnt have *intercourse* so .. thats the best part of this .. and you mentioned earlier
that it was *consensual* .. that may or may not matter .. but hopefully, you'll get a great Judge,
and *the girl* will confess that it was indeed consensual .. That, and you have no *previous record*..

And I mean not so much as a parking ticket! .. You may .. and I stress may have a nice judge
and by hiring the right lawyer, and the girl telling the right story, and everything in this case
going as perfectly as it could .. like her friend fessing up to being a jerk and even mentioning it,
and the parents of the girl not freaking out too terribly about it .. (and they should'nt,
have they raised her wrong?) I mean, what's *her *history*? Has as she slutted around?

If she's *been around* and you have witness's who can testify to that .. and her parents
have *had issues* with her in the past ... (and a good lawyer can/will bring that out)
and *the girl* also accepts her *lack* of responsibility .. I dunno ... I do know however,
that the Court System doesn't wanna fawk you up .. you're young .. you made a really bad decision ..
If you're clean up until now .. they won't fawk you .. unless .. you get a shitty lawyer
and you dont bring anything to the table .. and she lies .. and her parents have not had issues
