    Buyer/Seller shipping responsibility

So first off I want this to be an adult conversation I do not want to hear any trash talking to each other.

Well I have a question to ask everyone, if you buy and sell on the forum who should be responsible for the package after its been shipped?

Example 1: So you buy an item from a member and he provides you with a tracking number. The item gets lost in the mail and you do not get it. Who should eat the cost of the lost item? Should the seller refund the money? Or should the buyer get stuck with no money and no part?

Example 2: So you buy an item the seller and gives you a tracking number. You check the number and its says delivered but you did not receive your item. You contact the seller he says I shipped it and gave you a tracking number its your problem now. Who should be responsible?

On both examples no insurance was purchased, either because the seller was to cheap to pay the extra $3 or the buyer did not ask for it or was also to cheap.

I just want to know what people think on who should take responsibility when buying and selling anywhere, eBay, this or any other forum.

Now that you ask that should the buyer or seller be responsible for adding insurance? Especially on something expensive like let's say some 1 piece headlights.

      And no, NO Insurance

I feel that in example 1 The sender should be responsible, should have got the insurance.

In example 2 I feel the sender did everything they were supposed to. If it says it was delivered and it's not there, that's on the delivery service. The sender isn't responsible once the package says delivered. Just my .02.

Well let me use my situation as an example. Before the site went down I sold a nose mask to GunRunner I shipped it and gave him a tracking number. A week goes by I check the tracking number and it says delivered so I pm GunRunner and ask him if he got it.

He tell me no it was delivered to a different city and its 2 hours away from me. I could have said well I shipped it and gave you a the tracking number its your problem now. But I didn't I took it upon my self and called the post office and explained to them what happend. The post office made a lost package claim and gave me a claim number and told me they would investigate. I contact GunRunner gave him the claim number and tell him they might contact him.

Well the site goes down and I don't know what happen since I can't pm him. This whole time I'm just waiting for a paypal claim. Well about a week goes by and GunRunner sends me an email and tells me "Hey I got the package"so I was cool the problem got fixed. So I think as the seller I could not just wipe my hands and tell the buyer "Hey I shipped it now its your problem" that's not good customer service even do I'm not a store but a private seller. Just doesn't feel right to me.

well that's good things worked out in the end but if you ever sell anything again on here or where, I would always ask for insurance. It's usually not much but it will save both parties from a major headache.

That wasn't part of the question, you just asked who's responsibility it was. As a sender I feel they should try and remedy the situation, IF they can. No one ever said you should/could just wipe your hands.

I had a situation just like this happen recently, I shipped an ECU back to someone, and UPS.com shows it was delivered on X day on the porch. At that moment I'm not liable, but I asked the seller if they wanted me to pursue it, he said no because it was delivered to the address provided. I felt bad because I felt like I failed on the deal, but he was " No, you did your part ". Besides there's little you can do if it says it was delivered, to your porch non the less.

                Glad it got worked out.

Just a note. I'm not sure for USPS, but UPS is automatic insurance up to $100. FedEx is probably similar. At least ask before sending.

I'm pretty sure its UPS as well since i just paid for insurance on something via USPS

I feel the seller should be responsible on informing the buyer if he/she wants insurance. Most people don't think about it and when something happens people are left with sour tastes in their mouth

I sold someone on here something and it never came. We just agreed that it was lost and i never had to refund his money

Another member on here sold me a pt6 ecu. He mailed it out and it said it was delivered but i never found it. I felt like it was my fault since it was out of his control completely. I just told him its alright and i don't really care

In another situation i sold a buyer 2 moonroof visor clips and shipped them in a shitty envelope. Some how 1 of the 2 clips managed to get lost. We just considered it a loss and i kept the $5.

Last situation, i sold a buyer a console for an acura legend. It was broken in half during shipping. we agreeded that i would refund 50%.

I think on something small you can call it a loss. But on something big like the center console, headlights, thin moldings, flushmount, tail lights things like that are almost impossible to miss place someone should take responsibility. But I think the seller should offer the option of insurance and if the buyer does not want it then that's his fault and should not complain.

The thing that bugs me is paypal, you can send them proof of shipment like a tracking number and a receipt and they will still side with the buyer. There's no real protection for the seller.

As a seller, I always get insurance and delivery confirmation.

As far as being marked delivered, that is joke. Unless you pay for a signature confirmation you have now idea where it is delivered. Three of my last seven usps deliveries to me have been delivered to the wrong address. Sad part is, it is the regular mailman screwing up.
