    Car totaled (Other driver fault) - Insurance Issues

    Hey everyone, hows it going? its been a while i have been on here. So this weekend some drunk driver crashed right into my dad's car which was parked on the street. Pretty much destroyed the rear left side, near the fuel tank. ripped open the passenger side door and damaged the driver side door. Bent the rim etc.

    Anyways, the police caught the guy and they came to our place to tell us what happened. Anyways this was last weekend. Throughout the week I have been trying to contact our insurance, who on our behalf have opened a claim case. From what our insurance is telling us that as we only had 3rd party they have to wait for other insurance to pay up which is fine. BUT here is the deal, apparently the driver who crashed in had a brand new car with a 'provisional insurance'. Apparently it wasnt full insurance and the policy number the cops gave us was a 'temporary' number. and that it may take up to atleast a one month or 30 days for them to get the actual policy and then few weeks more for them to process a claim.

    My insurance company gave me the other party's insurance contact number. I called them and they said they had NO proof of a claim even been filled or even an accident been reported. WTF? they said to get the client's name and for that I had to call the police. I called the police and they said that the insurance company shouldn't be pushing me around and MY insurance company should be handing this properly instead of making me wait.

    I am at a total loss here. My mom's car is at a point of breaking down and we had plans to originally replace it. The this shit happened. My cb7 is in the shop due to Main fuel relay and spark plug issues. From having 5 cars in the driveway last year i am down to 1, and that is being used by my dad as he needs it for work. Can someone please help me with this? really confused as to what to do here.

    P.s. the car that got totaled was a 1995 Chevorlet Lumina. Book value is around 1800-2200. My dad got some work done on it due to his daily travelling, almost around $1200. Can we recover this amount? Also how can we get the other insurance to pay for taxi and stuff?

    well first of all...your saying the police have spotted the accident occuring that he the witness in the event....the Police should have filed a report on the accident claiming it was a total loss due to his penatly of drunk driver. meaning the drunk driver would have been arested, and should be filed under law?, Also make sure you report again till there is claim in getting money for the car. keep on calling about it!!...it will take mabye weeks even months....ask your insurance if your covered by rental too, meaning no car to drive, daily job..need transportation..so they will lend you a rental car....this also depends on what type of insurance you got.

    Can we recover this amount??

    ^^^^^ yes you can.....when you purchase...you always keep your set reconds and receipts on what parts you purchased on the vehicle.............if not, then give them photos on what mods you did on the vehicle depending if they would believe it at first....then they will evaluate on both the purchases on the vehicle and the value of the car and average on whether to fix the car or give you a sum by paying you decent amount in purchasing another vehicle...

      Hey, thanks man. Good to hear from a fellow canadian. Yes, the police has all the records , its the insurance companies that are being a b*tch for no reason. What I dont get is when the other party's insurance said that a claim hasnt been filed? i mean do people have to report an accident to their insurance if they shoot into someone else car? I guess you are right I have to call them atleast 3-4 times a day, but I am afraid they might delay my case for being a pest. or something.

      And no, my company isnt giving us a rental as mine was only 3rd party. But i plan on submitting the taxi receipts and the receipts of work done on the car with the claim.

      Man these guys can take your money in a second, but are jerks when it comes down to payout.

        I don't know about you but if someone smashed into my car and i had no other vehicle to drive, i'd be calling every freaking day until I hear something.

          90% chance you will not get money for the work done to the car if it was maintenance... Aftermarket modifications such as wheels, suspension, etc will usually be paid for if you have receipts...


          But the book value is based on a car in good working condition if it took $1200 to get it to that condition then all you did was bring it up to book value...

            I agree, its just that i work night shifts so we can share cars for now. Getting my cb7 back today. So hopefully this should help.

              Hey man, your post makes sense. The work done was maintenance like new tires and stuff. So the thing is, the book value of the car is 1900-2200 @ Vmrcanada.com for a 1995 Chevorlet Lumina with 240,000 on it. So i should get atleast this much, I suppose. I mean offcourse i cant expect them to pay 2000+1200= 3200.

                I was in a hit and run (similar to what you might call yours: hit and took off) since the "other" diver fled, the police 100% faulted the other car. After I came out of the hospital due to a heart attack at the scene, I got a lawyer and he claimed to MY insurance company, Uninsured Motorist. Also Personal damages resulting hospitalization. I called my lawyer daily and then weekly for almost a year. My van, a Super Shuttle Blue van was fine but I wasn't. Finally, 1 and a half years later they settled for 60K and I got 40K. Used some to buy the wagon. Hope you get more!!
