Last night I talked to some of my more informed friends, to be sure I was not talking out of my ass.
And I do have to apologize and make a correction.
If the burglary occurred on MY (or the OP's) property, THEN I could use force.
On a companies property, unless I am stopping the robbery of their establishment, I cannot use force.
In general public areas, unless I see a crime that threatens my life, or another's life, I cannot use force.
Location seems to be important in these cases.
So, even had OP had a gun, he could nor have shot the guy. He could have brandished, trying to get the perp to cease his burgle, but not shot at him.
