and no its not lint. when zoomed in, you can tell its a lot of noise created during scanning. or is there ink that causes issues when attempted to be scanned?

What finish is on the original? If it's a non glare finish that has some texture, you might get this problem. You might try scanning it at a different resolution to see if that helps any at all.
It does look like dust though, especially since there are two spots on the right side (above their cuffs) that don't look like noise, but have some "bulk" to them and aren't just single pixels.

change the DPI settings. if that doesnt work change the levels in photoshop. if that doesnt work then use the patch or clone tool. good luck!
