    Looks like I am going to small claims court

    It looks as if I am going to be going to small claims court for my wrecked moped. The lady wont answer the phone and the husband wont reply to my emails. If anybody is out of the know, a moped I sold to a lady broke down and after 3 weeks of waiting on parts, I finally broke down and felt sorry for her because that was her only mode of transportation and it was 2 miles to the nearest grocery store. She had been walking the past 3 weeks and I told her she could borrow my scoot as long as she signed a contract saying if she tore it up, she was going to have to pay for it. Sure enough she got drunk and some how or another somebody hit her or she hit something VERY hard. Its been 3 weeks and I havent seen a dime from her. She said her dad was going to pay and all that good stuff and I would get a check for it very soon. Still no check. They are all ignoring me and I have to go find the husband and talk to him about it and let him know the circumstances of not paying. If he is ignorant about it, then they will be going to small claims court with me. They currently owe me $600 for damages to the scooter and $200 for the towing fees. I actually paid $700 my cost for the scooter and I depreciated it for them. Oh well, this time I am prepared. I have a contract, invoice for the scooter, and towing slip.

    Right now I need a police report and some other stuff before I can take her and for sure win.

    You will win in court easy but will never collect probably... Either she is a drunk and lost her license to a dui... Or she is to poor to buy a car... Or she is too mentally ill to own a car... You are screwed.... I sued a huge company before they went out of business... They still owe me 3k from years ago... Good luck collecting for just one scum bag.

      PS you are I assume selling pos Chinese scooters... Everyone knows parts are hard to get (if you can even get them)...I would of told her to screw.

        Oh they are actually easily attained by the distributors. I can drive 3 hours to pick them up haha. But yea, in SC if you dont pay, you go to jail.

          I can tell you for a fact that isn't true. No one goes to jail for a debt"legally".. Contempt, fraud or tax evasion yes.. debt no.

              Im not to worried if its going to take months. I understand that and I guess I am willing to wait on it. It wasnt my last 800 bones so its all good. I wonder how I can report her to credit agencies to ruin her for good.

                I felt sorry for the lady when you posted about the accident, but I don't feel so bad anymore. Sucks for her that she got hurt, but she damaged your property. If she's not so seriously hurt that she's immobilized, then she's not so seriously hurt that she can't pay you. If I remember correctly, you said it was a hit and run, followed by a robbery... do you doubt the truth of that now?

                My friend has a Chinese "Tank" scooter. It's basically a fairly accurate Honda rip-off. The dealer said that when something breaks, a Honda part can be used to replace it. Assuming that's true, those parts are quite easy to come by!

                    When the case
                    she will not pay
                    you pay a collection agency to go after here... It will then go on her credit



                    You can have a lien put on her house if she has one with equity. When she sells it in 25 years (if she even has one) you will get paid ...

                        Yea the best I can do is get it out of her paycheck or something. Sad thing is she doesnt work. I cant stand the way small claims court works these days because they dont do anything about the people who dont pay. I have a good feeling its gonna be a while before I see any money.

                          Why would you lend a scooter to a stranger? Should have taken collateral beforehand, but the contact was a smart move.

                            The contract was definitely smart.

                            I can see being a nice guy and lending it out... that's how people SHOULD be. Sadly, people just aren't honorable anymore. I guess since she got hurt, your loss doesn't matter, right? Suddenly, when her world gets tough, screw everyone else... inlcuding the guy that did her a favor.
