    I feel that it's going too far. While I don't condone drunk driving, and I DO agree that strict measures should be taken to combat it... there are other ways.

    I agree with this statement: "The nation's highest court ruled in 1966 that police could have blood tests forcibly done on a drunk driving suspect without a warrant, as long as the draw was based on a reasonable suspicion that a suspect was intoxicated, that it was done after an arrest and carried out in a medically approved manner."

    That makes sense to me. Don't change a good thing.

            But heres the bottom line, when a cop pulls you over, and youre drunk. he or she will know. So if you dont submit to either your bloo being drawn or the B-Z...they can still get cha.

                This is already taking place in NY. A friend of mine who got caught had it done. I don't think that officers should be doing this. If the law says that the blood should be drawn in a medically approved manner i dont see the side of the road or a jail cell being a sterile or clean enough environment to be carrying out these types of tests. I also feel that this crosses a line of personal space when they say that a judge could give permission to forcibly take blood from a suspect. Does this mean that everyone getting pulled over is going to be expected to give a blood sample? This is one of those things that annoys me when they leave it up to the officers' discretion... meaning whether or not the cop is right or wrong if they feel they want to take your blood then they can and will.

                  What if the person being tested is a hemophiliac? And due to an unexpected movement by either the person or the officer... for whatever reason (cough, sneeze, some kid driving by at 90mph, etc...) and the needle rips the person's skin. Then you have a serious medical issue. One that could be avoided with a less intrusive method, and one that the officer is not equipped to handle properly.

                  An extreme situation, sure... but why should anyone be put at risk?

                    *did not read article* Ive heard and spoken with various attorneys over this, and most of the lawyers are fighting this because hey even they drive drunk. On another note, we urinate, we defecate, we salvulate(sp?) , we produce ear wax , we ejaculate and we tear. Our body does not in any case other than an abnormalty allow bleeding. We as humans do not release blood unless something truamatic just happend. They should not be taking blood away from me ever, If captain jolly rainbow facade decided to stick a syringe into me Id rather admit to the officer and go to jail even if Im not drunk. Just for the sake of 1. contracting one of many many diseases 2. being scared for life 3. loosing blood. Usually I dont disagree with po pos but this is to far hence, i dont say this often, - "fuck the POLICE "

                      And you started so strong, but finished so weak.

                      1) the procedure is not going to give you any diseases. I'm sure they follow the same guidelines as the red cross concerning cleaning the area, and using clean needles.
                      2) How would you lose your life from losing a syringe worth of blood? Before my surgery I gave 2 pints in 2 weeks. That's a lot of blood, and I was fine. A little woozy if I stood up fast, but other than that, no big deal.
                      3) again, unless the syringe is hooked up to a 2 liter, you'll be fine.

                      I do hear what you are saying though, about how there are plenty of other ways to get the sample besides blood. That is a valid point that cannot be argued.

                            If you are too drunk to drive, a breathalyzer usually works just fine. A well-trained officer should be able to identify an impaired driver as well.

                            I would support a blood test in the event of an accident, or any other extreme situation. it shouldn't be done on the side of the road. If a guy is hammered, he'll still be hammered 30 minutes later when he's back at the station.

                                if you got nothing to hid go through the breath thing and you'll avoid the blood being drawn from you
