      really? i have no idea what nitrous is, i bought it cause it looked pretty and christmas is comming up and i thought my brother would like such a gift

        Now the real question is... is an online purchase a binding contract immediately? Is it a purchase from the moment you confirm that payment? Is there a Zex dry nitrous kit sitting in their warehouse now that legally belongs to me right now?

        That's what the law will look at. Even though we made these purchases conciously aware of their error, does that make the sale invalid? Money was accepted. That's a contract.

          But it's the internet. Which makes every law half-valid here.

          I am also intrigued by this nitrous kit. I heard they normally go for $60 and I need one as a gift for my mechanically-inclined grandmother this year.

            well i just looked at my visa card overview online from my bank...and my current balance says that money has been charged on it....so, im guessing they took my money....i want my no2 now!

                    nobody will get the kit, you will all get refunded. you wont even get a gift card.....promise. i have seen this happen before but with lowes home imporvement. they are safe from any lawsuits, you will all get emails tommorrow and refunded asap. calm down already.

                      I would recommend that anyone that gets a letter about this saying refund blah blah blah, start making a lot of noise about truth in advertising, completed sales, money being taken already, and never doing business with partsamerica.com or their associated stores (The PartsAmerica.com Team includes Advance Auto Parts, Checker Auto Parts, Schuck's Auto Supply, Kragen Auto Parts and CSK Auto, Inc., some of the largest auto part retailers in the U.S. ) ever again. They can choose to lose 1.4 million and change or hundreds of millions in lost future sales. If it was my company, I know which loss I'd choose to take.

                          That's what makes this tricky. A catalog price could be dismissed as a typo at the time a potential buyer attempts to make a purchase. In this case, the purchase was made at the advertised price. The question is, can they go back on a sale once it's complete. We sent money for goods at an advertised price. The transaction is complete, aside from having the item shipped.

                          Is the nitrous kit in their warehouse my property that I legitimately paid for, or is it still their property, leaving it to be at their discretion whether or not they send that or a refund?

                            That whole "we're never gonna shop here again for any reason you'll lose millions off of us" thing never works. I'm sure they'll really miss our yearly $16 wax and oil purchases..


                            As far as I know stores can change it after you're charged. Just a week ago I ordered a JDM trash box from ICBmotorsport and got free shipping. I couldn't get it to show, so I just took it to mean free shipping. They billed me for my original order, then billed it for the order plus shipping. Without consulting me. I had to email them to take it off.

                              this has turned out to be so big my local store knew about this and said to not bother trying to purchase a kit, i couldnt contact anyone by phone becuase it seems to be busy....but a simple screw up on online pricing seems like a big deal but the most you all will get is a refund of exactly what ya paid.

                                Most likely. That's pretty much what I expected... but it doesn't hurt to try!


                                Still, my questions are valid. Only in a court... but they are indeed valid. The terms on their site are quite vague.
