maybe I get to sue Hollywood PD....

...for fucking up a police report!!!!

For most of you who DON'T know... We suffered a sad loss a month ago; coming out of this killer club in hollywood, we go to the car, my husbands 98 V6, which is parked ONLY a block off the main Blvd, and NOT in a ghetto...

not to mention the fact that the front end was smashed in bad enough that we had to rip off the bumper and leave it, i don't have pics of that, but this WAS the front end...

so imagine all that shit ripped off, hours of work just destroyed.

But i guess what really sucks is aside from my laptop ,they didn't take anything but a sweatshirt, some keys, and ripped the panel out from under the steering column - like they were gonna hotwire it but pussed out. I was pissed because i figure, if youre gonna fuck up a car, do it RIGHT! all this shit is just annoying...

...so i call hollywood pd at 4am to file a police report - and it's standard in this situation to take the report over the phone, so i don't ever get a copy, just a "call us at this number in a couple days and we can provide the report number for you to tell you insurance company," and in my stupor i don't ask for her name.

well its been a month, and yesterday i call the pd for the report number, give them like all my info and they CANT FIND IT! so i call back later hoping to get someone different, and she cant find it either, but gives me the number for their watch captain ... at this point im thinking, fine, if i have to file another report, i'm pissed, but it will be done...

...well long story short, he looks into it and calls me back saying "we have a report in your husbands name, but its for JUNE 27, 2004 not JULY 17, 2005 and for a 1999 Honda. She found it for you, but didnt want to give up the information because she wasnt sure if you were the right person..."

...i just about told off the cop on the phone but i know it wasnt his fault - i just asked what was i supposed to do? my insurance company is gonna think im trying to fraud them out of $3000... and he says "there's nothing we can do about it now"

so i call my insurance company right away to tell them, and this dumb bitch says "well why is that date wrong on the report?" like HOW THE FUCK am i supposed to know?! so, even with a million questions on my mind, i said "i don't know, thanks for taking the note" and hung up on her. Called back later to chance it at getting someone more competent - who basically told me, it SHOULD be ok, but we'll see and that i have to wait until the powers that be get an ACTUAL copy of the report to go over

    ...that could be 12 weeks...

    ...i am livid....

...if that bullshit screws me out of the money i need to fix that car, it's over...

thanks for letting me rant i know you guys are always good for it

I wouldn't count on them being reasonable....just based on past experience. Their sole purpose is to collect as much money as possible, while paying out as little as possible. Not to say that you won't get lucky, just be prepared. Start collecting your phone bills. That way you can prove what date and time the call to the PD occured. If the only call to Hollywood PD occured on 7-17-05 at 4:00am and there was no call on June 27, 2004, the insurance company will have a lot less room to wiggle. Also, get the PD to talk to the reporting officer or get ahold of them yourself, and see if they can look at the report and recollect the date/time. Maybe the secretary just entered the information wrong because she mis-read it.

If you had any friends that saw the car shortly before the incident (preferably the same night, but as late as the day before) get a written statement that the car was not damaged when they saw it. It would be even better if you could get a statement from someone who saw it before and after. Maybe a friend that was with you that night.

As a last resort, recent pics would help to, although if you can get the stuff above, they won't really be able to argue.

As far as the value of the aftermarket stuff goes, get receipts for the labor and parts. That will help you out a lot. I am not as familiar with CA law, but I know that here they are not required to insure the aftermarket parts unless you take out extra coverage to do so. I know that CA law provides a lot more protection for the insured than Arizona does, and they seem to be more interested in "Like and Kind," so the receipts may be enough.

If I think of anything else, I will let you know. Good luck.

the shop that did the estimate has sent "recent" pics, and fortunately a friend WAS with us that night.. it was his triplefivesoul sweatshirt that got ganked

and its funny you should mention my phonebill - it came in the day i called the pd... and i was looking at it saying "i know it was THIS office that i called, so it was one of YOUR people that took the report" -- i didnt even live here last just, i was in philly with a philadelphia number

as for my coverage on the aftermarkte parts, when we moved here and had our policy rewritten, i asked "do i need an appraisal for the new parts, we've put a ton of time and money into this car" and she TOLD ME "as long as your coverage is enough to cover what you have and you can show through pictures or receipts or both, you don't need an appraisal" -- so i have both, and i have that loophole, because that is what the policy writer told me

this is just a huge pain, really - i hate having to put on my mean face and be the well-informed-not-backing-down-until-i-get-what-i-deserve consumer, but i guess thats what i gotta do this time!

**edit** i know that i WILL get screwed on labor, b/c we're taking a check from the insurance company because i DO NOT let other people touch my cars... so we'll get labor on the oem parts, but not for fabrication and modifcation of the fiberglass.... but thats just a small bit of the rest, which i hope to get all of that $3000

It sounds like you have all the bases covered which is a good thing. You have already won half the battle. They will still try to get you to back down; I have argued with them over $15 before. Like I said, hopefully you won't have that problem. Just don't back down and it is all you.

Also, if they get really hardnosed on you, you always have the option of small claims court, which provides you with a lot of protection from the "legalities and formalities" of the court system. You have enough of a case to not have to fight too hard.

                Good Luck!!

This could drag out for quite some time but in the end it will work out in your favor. There's just tons of BS to put up with until then. I feel for ya. Good luck!

Wow... that really sucks! I hate when those we rely on to be responsible (in your case, the cops) screw up... You're just kinda stuck in the middle of two giants (police and insurance) and you can't do much! Keep calling and making a fuss... or sue

USAA is exceptional. You shouldn't have any real problems with them.
